Terms of Service

These Terms of Service (“Terms”) govern your access to and use of services, websites, and products provided by PProxy.app (“PProxy”, “we”, “us”, “our”). By using the Services you agree to these Terms.

1. Accounts & Eligibility

  • You must be at least 18 and have authority to enter into these Terms.
  • You’re responsible for credentials and all activity under your account.
  • We may refuse service, close accounts, or change eligibility at our discretion.

2. Services

PProxy provides proxy networking across residential, hosting (datacenter), and mobile networks, offered as metered (per-GB) and unlimited (time-based) plans. Features may include static or rotating sessions, rich filtering (ASN/ISP/Country/Region/Subnet), and global coverage.

3. Orders, Billing & Taxes

  • Fees are in USD. Taxes/processing fees may apply.
  • Metered usage is measured in GB and billed by published tiers.
  • Unlimited pricing is time-based by selected duration.
  • All charges are non-refundable unless required by law or explicitly stated.

4. Fair Use Policy (Unlimited Bandwidth)

Network protection

Unlimited bandwidth plans are subject to a Fair Use Policy to protect network quality for all customers.
  • Indexing date: usage is indexed and evaluated on the 30th of each month.
  • Threshold: if a customer’s monthly usage is 10× higher than the average across active unlimited plans that month, we will contact the customer to review and optimize usage.
  • Second occurrence: we will contact the customer again and rate-limit proxies to 8 Mbit/s for the remainder of the current cycle and potentially subsequent cycles until usage normalizes.
  • Severe abuse: immediate action (including suspension) may be taken if usage degrades network performance or violates the AUP.

Details of technical measurements, sampling intervals, and averages may be adjusted from time to time to better protect network quality. We will act in good faith and strive for transparency.

5. Acceptable Use

You must comply with our Acceptable Use Policy. Prohibited activities include illegal conduct, harm to networks/third parties, spam, credential-stuffing, and other abuse.

6. Suspension & Termination

  • We may suspend/terminate for violations of these Terms or the AUP.
  • We may suspend to protect our network, customers, or third parties.

7. Intellectual Property

We and our licensors own all rights in the Services (software, docs, branding). No rights are granted except as expressly stated.

8. Warranties & Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR SUCCESS ON ANY PARTICULAR DESTINATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PPROXY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE/DATA, BUSINESS INTERRUPTION, OR SUBSTITUTE SERVICES. OUR AGGREGATE LIABILITY IS LIMITED TO AMOUNTS YOU PAID TO PPROXY IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You will defend, indemnify, and hold harmless PProxy and its affiliates, officers, employees, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services or your violation of these Terms or the AUP.

11. Compliance & Export

You are not in a sanctioned jurisdiction nor on a denied-party list. You will comply with applicable laws, including data protection and export controls.

12. Changes to Services or Terms

We may modify the Services and these Terms. Material changes will be posted. Continued use after changes means acceptance.

13. Governing Law & Venue

These Terms are governed by the laws of The Netherlands. Courts in Amsterdam have exclusive jurisdiction.
